Surcharges are fees that a retailer adds to the cost of a purchase when a customer uses a charge/credit card. A surcharge is a percentage of the value of the sale. For example, if a cardholder spends $100 on their credit card for lawn maintenance, the merchant would add a surcharge of 3% to the total charging them $103 for the purchase.
Surcharging credit cards is legal in most states in the United States, but not all. The legality of surcharging varies by state and is subject to regulatory restrictions and requirements.
No! You are not allowed to surcharge a debit card transaction. Funds are debited directly from the customers bank account and should be treated like a cash, ACH or check transaction.

Yes! You must notify your customers with complaint signage, and the surcharge dollar amount must be present on every receipt.
Prior to April 2023, the maximum surcharge percentage was 4%. Starting April 15, 2023, Visa dropped the percentage to 3% maximum on credit card transactions. Remember, you can’t surcharge a debit transaction!
Yes! There’s absolutely no credit card fees for surcharging transactions. However, debit cards, ACH and other non-cash payment types will still acquire processing fees. Additionally, your account will still have standard compliance and merchant account costs.
